In May this year, the Michigan Legislature passed an amendment that changed the foreclosure process Michigan Pre. The legislation, which was signed by the Governor on May 20, 2009 and entered into force on July 5, 2009, creates additional steps before a mortgage can be excluded. With Michigan facing one of the highest high foreclosures in the nation, lawmakers hope these changes will help homeowners stay in their homes.
Under the new legislation, enforcement proceedings will not begin until 90 days (instead of 30 days) after the initial notice is sent to the borrower of the loan to enable comply with the mortgage lender. The written notice must indicate the reason for the mortgage loans in arrears and the amount owed by the borrower. The borrower may be required negotiating face to face and try to work with the lender in a loan modification possible. The notice must also provide a list of housing counselors provided by the Michigan State Housing Development Authority, and phone numbers of local offices of legal aid. If the lender and borrower's agreement in terms of a loan modification within 90 days, there can be no foreclosure. The amendments include taxes interest rates are low and reduce or eliminate late fees.
The amendment applies only when the property is the residence of debtors main. It also does not apply to judicial foreclosure actions because this process takes about a year since the start of the foreclosure sale of the house. The amendment should extend the foreclosure process between two and four months since before the amendment was enacted.
